Service Description

Torrey Pines Tee Times ("the Service") is a personal booking assistant that monitors tee time availability at Torrey Pines Golf Course and notifies users when matching tee times become available. For Auto-Book users, the Service also books tee times on your behalf using your own ForeUp account credentials.

No Affiliation

The Service is not affiliated with, endorsed by, or connected to the City of San Diego, Torrey Pines Golf Course, or ForeUp. We are an independent service that acts on your behalf as your personal booking assistant.

User Responsibilities

By using the Service, you agree to:

• Provide accurate and valid information, including a valid email address.
• Provide valid ForeUp credentials if using Auto-Book. You are responsible for ensuring your ForeUp account is in good standing.
• Not use the Service for commercial resale or brokering of tee times.
• Not attempt to abuse, overload, or interfere with the Service.
• Comply with all applicable rules and policies of Torrey Pines Golf Course and the City of San Diego.

SMS Text Message Terms

By opting in to SMS notifications on our website, you agree to receive autodialed text messages from Torrey Pines Tee Times regarding tee time availability and booking updates. You understand and agree that:

• SMS notifications are optional and are not required to use the Service.
• Message frequency varies based on your configured preferences and tee time availability.
• Message and data rates may apply. Contact your wireless carrier for details about your messaging plan.
• You can opt out of SMS at any time by replying STOP to any message. You will receive a confirmation message and no further SMS messages will be sent.
• After opting out, you can opt back in by replying START or re-enabling SMS in your account settings.
• For help, reply HELP to any message or email admin@torreypinesteetimes.com.
• Compatible carriers include but are not limited to AT&T, T-Mobile, Verizon, Sprint, and most major US carriers.
• Torrey Pines Tee Times is not responsible for delayed or undelivered messages caused by carrier issues or device incompatibility.

Your consent to receive SMS messages is not a condition of using or purchasing any service from Torrey Pines Tee Times. See our Privacy Policy and SMS Terms & Conditions for full details about how we handle your phone number and messaging data.

No Guarantee of Booking

While we strive to book tee times as quickly as possible, we cannot guarantee that any particular tee time will be successfully booked. Tee times are subject to real-time availability and may be claimed by other users before our system can complete the booking. The Service is provided on a best-effort basis.

Auto-Book Pricing

Auto-Book is currently offered at beta sale pricing of $5 per player per confirmed booking (regular price: $20 per player). You will only be charged after a booking is confirmed. Tee time notifications (notify mode) are free.

By enabling Auto-Book and adding a payment method, you authorize Torrey Pines Tee Times to charge your saved payment method $5 per player for each successfully confirmed booking. Charges are processed after admin verification of the booking.

We will notify all users before any pricing changes take effect. You may cancel Auto-Book at any time by switching to notify mode in your dashboard settings.

Payment Security

All payment processing is handled by Stripe, a PCI Level 1 certified payment processor. When you enter your card details, they are sent directly to Stripe's secure servers. We never see, store, or have access to your card number, CVV, or full billing details. The only payment information stored on our servers is your card brand (e.g., "Visa") and last four digits for display purposes. See our Privacy Policy for full details.

Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law:

• We are not liable for any missed tee times, failed bookings, or incorrect notifications.
• We are not liable for any fees, penalties, or consequences arising from bookings made or not made through the Service.
• We are not responsible for any changes to ForeUp's systems, Torrey Pines policies, or City of San Diego regulations that may affect the Service.
• Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Account Termination

We reserve the right to suspend or terminate any account that:

• Engages in abuse of the Service, including excessive automated requests.
• Attempts to resell or commercially broker tee times obtained through the Service.
• Provides false or misleading information.
• Violates these Terms of Service.

You may stop using the Service at any time by deleting your searches from your dashboard or by contacting us.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
